Understanding the National Redress Scheme

The National Redress Scheme was established in response to the Royal Commission into Institutional Responses to Child Sexual Abuse. It provides survivors of institutional child sexual abuse with access to counselling, a direct personal response from the institution, and a monetary payment.

To be eligible for the Scheme, you must:

  • Have experienced sexual abuse as a child while in the care of a participating institution
  • Have been born before 30 June 2010
  • Apply before 30 June 2027

 

What the Scheme Provides

Survivors who qualify under the National Redress Scheme may be entitled to:

  • Financial Compensation: The amount is determined based on the type and severity of the abuse, as well as the nature of the institution involved. The maximum payment is $150,000, although most survivors receive less.
  • Access to Psychological Support: Survivors can receive funding for counselling and other mental health services to aid in their recovery.
  • Personal Response from the Institution: Survivors have the right to request a direct response from the institution responsible for the abuse. This could include a formal apology or an explanation of the measures the institution has implemented to protect others from similar harm.

Eligibility for the National Redress Scheme

To be eligible for the National Redress Scheme, several criteria must be met:

  • The abuse must have occurred in an institution that has agreed to participate in the Scheme. Unfortunately, not all institutions have opted in.
  • You must be an Australian citizen or permanent resident to qualify.
  • If you have been sentenced to five or more years in prison for serious crimes such as unlawful killing, sexual offenses, or terrorism, you may be ineligible.

Recent changes to the eligibility criteria, introduced in March 2024, could affect your ability to make a claim. It’s crucial to consult with legal professionals to understand how these changes might apply to your situation.
